General Conditions Users younger than 18 years old may not shop on cemsilvershop.com Consumers, by electronically agreeing to this contract, also confirm that they are older than 18 years old. Seller shall not be responsible of price and content mistakes that may arise due to typos and system faults on cemsilvershop.com. Seller reserves the right to cancel the orders with the incorrect price. Consumer, when they shop on cemsilvershop.com, agrees that this purchase is for personal use only and not for reselling purposes. Consumer, by electronically agreeing to this contract, confirms to have received all necessary information that should be provided by Seller to Consumer, correctly and completely, including address, phone number, basic features of the ordered product, product price including taxes, payment and shipment information. If the product price is not paid for any reason whatsoever or cancelled in bank records, Seller shall be deemed to have been relieved from its obligations to deliver the product. In orders via bank wire or EFT, orders shall be put into process on the day when the payment reaches Seller's bank accounts, but not the day of placing the order. Consumer, in orders via bank wire or EFT, agrees that Seller cancels the order if they do not make the payment within 1 week. If the payment is made by credit card or a similar payment card and if the bank or financial institution does not pay the product price to Seller due to unauthorized or illegal use of the Consumer's credit card, after the product is delivered, Consumer shall be obliged to send the product to the Seller within 3 days, provided that the product is delivered to the Consumer.
Article 6
Seller's Responsibilities Seller shall provide the consumer's order within thirty days following the receipt of the order. This period may be extended for ten days at most, provided that the consumer is notified in written. Seller shall not be held responsible of failing to deliver the product to the Consumer in case that the ordered product is not delivered to the Consumer due to any reasons that the courier company faces when delivering the product to the Consumer. If the ordered product is not delivered because the Consumer at the delivery address has not accepted the product, Seller shall not be held responsible. Seller may offer to provide a product of equal quality and price, before the period of his obligation of fulfilment expires, provided that such replacement is based on a valid reason. For various reasons, ordered products may not be in production. If Seller fails to fulfil his contractual obligations suggesting that performance of the good or product subject to the order has become impossible, Seller shall inform Consumer before the period of fulfilment of his contractual obligations expires. Seller shall return to Consumer the paid amount and all documents that bind the Consumer within 10 days. Consumer reserves the right to withdraw this contract within 14 days following the delivery of the ordered product to him or person/entity located at the Delivery Address. For exercising the right of withdrawal, Consumer must contact the Seller via contact form, e-mail or phone on cemsilvershop.com website and the products must not within the scope of the Article 7 - Products for which the Right of Withdrawal cannot be exercised. Seller reserves the right not to accept the products returned without any notifications. Consumer or the third party shall be obliged to fully send invoice, dispatch note, certificate, insurance forms, product box, packaging and all other relevant documents and materials with the returned product. VAT and other legal obligations, if any, shall not be returned for the products sent without the original invoice. If during return shipment, any damages, disruptions or similar depreciating situations occurs in the product and the documents and materials sent with the product, due to reasons arising from the courier companies or Consumer who carried out the return process, all responsibility shall be borne by the Consumer. Within 7 days following receipt of these documents, the product fee shall be returned to the Consumer.
Article 7
Products for which the Right of Withdrawal cannot be exercised Consumers may not exercise the right of withdrawal for the products produced upon their special requests or for the custom-made products on which modifications or additions are performed. Therefore, products with custom writing on the stone upon the Consumer's requests and all products produced upon Consumer's request are included in the Products for which the Right of Withdrawal cannot be exercised.
Article 8
Competent Courts In performance of this contract, up to the value declared by the Ministry of Industry and Commerce, Consumer Arbitration Boards and local Consumer Courts available where Consumers or Seller reside are competent authorities. In case the order is realized, Consumers shall be deemed to have accepted all terms of this contract.
